Will | Caleb Hayes Will I Caleb Hayes of township of Newlin in the County of Chester and State of Pennsylvania Yeoman now being under some bodily indisposition but of sound and well disposing mind and memory remembering the uncertainly of this mortal life have a desire to settle and dispose of all my temporal set which I do in the following manner viz: Imprimis my mind and will is that all my just debts and funeral expenses be paid & discharge by my executor as soon as may be after my decease Item I give and bequeath unto my beloved wife Mary one feather bed and being one case of drawers the dough trough one pot kettles on a large brass one one tub four blue chairs all the pewter and tea ware and the use of the lower room in the new house with the privilege of passing and repeating to and from the same as she may have occasion & nine pounds a year all which I leave during the time she remains my widow in lieu of dower Item I give devise and bequeath unto my son Isaac Hayes all the Tenement Plantation Tenent[?] and parcel of land whereon I now dwell and situate in the said township of Newline within all & singular the appurtenances thereunto belonging to hold unto him the said Isaac hayes his heirs and assigns forever / except the reservation to the widow / Together with all the personal estate that is not herein otherwise ordered & disposed of he paying the said sum of nine pounds a year to my widow as afore said and all the legacies hereafter bequeathed to the rest of my children Item I give and bequeath unto my daughter Abigail Mileson the sum of five shillings to be paid in one year after my decease Item I give and bequeath unto my daughter Ann Cooper the sum of them pounds with what she have already had to be paid one year after my decease Item I give & bequeath unto my son Caleb the sum of thirty pounds to be paid when he comes of age out of which he is to be found clothes during his apprenticeship Item I give and bequeath unto my son Ellis the sum of thirty pounds when he comes of age Item I give and bequeath unto my daughter Ruth the sum of thirty pounds to be paid when she arrives to the age of eighteen Lastly I nominate and appoint my said son Isaac sole executor of this my last will hereby making void all wills and writings testamentary heretofore by me made allowing this and no other to be my last will & testament. In witness whereof I have hereunto set my hand and seals this nineteenth day of May Anno Domini One Thousand seven hundred and eighty [19 May 1786] Caleb Hayes [seal] The within and forgoing writing was signed seal’d published & pronounced & declared by the said Caleb Hayes to be his last will and testament in the presence of us who he desired to subscribe our names as witnesses whereof John North, Caleb Pierce NB it is the will of Caleb Hayes that his son Isaac shall provide firewood for his mother at the door fit for use as much as she may have occasion for. Thornbury 20th October 1786 Then personally appeared John Worth and Caleb Peirce who on their solemn affirmations according to law did severally declare affirm and say that they were present and did see and hear Caleb Hayes the testator with named sign seal publish pronounce and declare the foregoing writing as & for his last will and testament and that at the doing thereof he was oa a sound Y well disposing mind and memory to the best of their understandings. Be it remembered that on the 20th day of October 1786 the last will and testament of Caleb Hayes deceased was proved in due form of Law and Letters Testamentary were Granted Isaac Hayes sole executor therein named he having solemnly affirmed well and truly to administer & bringing an Inventory of the Decd Estate into the register office for Chester County on or before the 20th day of November next and to render a true and just account of his admin in a Year or when thereunto lawfully required given under the seal of sd office … [2] | |
