Will | Abigal Hatch’s Will — [land_hatchabigail_will_v5p344VT] In the name of God Amen, I Abigal Hatch of Grand Isle in the State of Vermont, of sound mind and once disposing mind & memory do make this my last will and testament. After payment of all my just debts funeral expenses and expenses of administration on my estate I devise the residue of my Estate and property of every description to be divided into seven equal shares, and devise and bequeath to my children: Asa L. Hatch Oscar E. Hatch, <—my 3x great grandfather Oscar Ebenezer Henry R. Hatch, Daniel M. Hatch, Evelyn D. Hatch and Arthur E. Hatch each one equal share which each of them is to hold as their absolute property in fee in severally. The seventh equal share I give devise and bequeath Evelyn D. Hatch to hold the same, in trust for my grandson Charles B. Merrill son of my deceased daughter Julia and having full confidence in the said Evelyn D. I hereby give her full power over said share to sell and dispose of the same and invest the proceeds for the benefit of said Charles B. as she shall see fit, and in the event of said Evelyn D. becoming capacitated to execute said trust then I hereby direct the said Arthur E. to execute the same, and hereby give him the same power over said seventh share as I have above given the said Evelyn D. and I do further devise that whenever the said Charles B. Shall arrive at the age of twenty one years that so much of said share as shall not have been expended in his maintenance and exudation shall be delivered over to him and become his absolute property in fee, but should the said Charles B. decease before he arrives at the age of twenty one years then I devise and bequeath that the share so devised to said Charles B. and for his benefit to be divided equally among my other children above named, that is to say: Asa L., Oscar E., Henry R., Daniel M, Evelyn D., and Arthur E. I do hereby nominate and appoint Oscar E. and Daniel M. Hatch executors of this my last will and testament Abigal Hatch Signed published and declared before us, by the said Abigal Hatch as her last will and testament, and we at her request have hereunto subscribed our names as witnesses thereto, in her presence and in the presence of each other, this day of September 2nd, 1861. Erastus Center Jeremiah Center Hiram Center Whereas I Abigail Hatch of Grand Isle of Grand Isle County State of Vermont have by my last will and testament in writing duly executed bearing date Sept 2nd 1861 giving Evelyne D. Hatch one equal seventh of all my property both real and personal after deducting the expenses set forth therein, since which time said Evelyn D. has deceased leaving one son named Claude Samuel Boundman[?]; Now I the said Abigal Hatch being desirous of altering my said will in respect to the said legacy do therefore make the present writing where I will and direct to be annexed as a codicil to my said will and taken as part thereof; the said seventh equal share I give and bequeath Oscar E. Hatch to hold the same in trust for my grandson Claude s. Bourdman/Boundman/Boardman afsd son of Evelyn D. I hereby give him full power over said share to sell and dispose of the same and invest the proceeds for the benefit of said Claude S. as he shall see fit. And I further direct that whenever the said Claude S. arrive at the age of twenty one years, that so much of said share as shall not have been expended on his maintenance and education shall be delivered over to him and become his absolute property in fee but should the said Child S. decease before he arrives at the age of twenty one years then I devise and bequeath that the share so devised to said Claude S. and for his benefit to be divided equally among my other children above named that is to say: Asa L., Oscar E., Henry R., Daniel M. (and Charles B. Grand) and Arthur E. Once I do rectify and confirm my said will in everything except where the same is hereby revoked and altered as aforesaid. In testimony whereof I hereto set my hand and seal publish and declare this to be my last will and testament this 26th day of June A.D. 1875. State of Vermont Grand Isle CountySS Be it remembered, that at a Probate Court, holden at the Probate Office in North Hero in said District, on the 6th day of January A.D. 1887 Present, Hon H. W. Allen Judge Whereas, Heretofore, to wit, on the 7th day of December A.D. 1886 at a Probate Court then holden at the the office in North Hero, in said District, Henry Harrington of South Hero on the District aforesaid presented to this court, being there Probate Court for said District, an instrument purporting to be the last will and testament of Abigal Hatch late of Grand Isle in said District, deceased testate, who had, while she lived, and at the time of her death, estate, real and personal, within said District, on which a will may operate. And whereas, on said 7th day of Dec 1886 this court did order that public notice be given, by a publication in the Burlington Free Press a weekly newspaper printed at Burlington, in this State, three weeks successively, the last of which publication to be prior to the said 4th day of January A.D. 1887 to all concerned to appear at the Probate Office in North Hero, in said District, on the day and year last aforesaid, at 10 o’clock in the forenoon, and contest the probate of said will. And Whereas, on evidence, it is made to appear to this court that the aforesaid order has been duly complied with on this 4th day of January aforesaid the court hen and there said proceed to the examination of Her Harrington, Juan Robinson and S. G. McComber and Erastus Center as witnesses to the signature of Erastus Center, Jeremiah Center, and Hiram Center witnesses to said insurgent and after a careful examination of said witnesses on their respective oaths the court decrees that the said instrument purporting to be the last will and testament of the said Abigal Hatch be and once the same is hereby proved and approved by this court, as the last will and testament of the said Abigal Hatch deceased testate. Allen Judge of the Probate Court within and for the District and State aforesaid, hereby certify the foregoing to be a true copy of the last Will and Testament of Abigal Hatch late of Grand Isle in said District, deceased, as was duly approved by this court and also the records of said court in proving and approving the same.
