    Be it remembered that ??? ?? on first day of April in the year of our Lotd one thousand eight hundred and forty three the said plaintiffs filed in our court of common pleas within and for the County of Monroe and State of Ohio their Bill in chancery against the said defendants in word and figures following to wit To the Court of Common Pleas within and for the County of Monroe and State of Ohio in Chancery witty Cornelius S. Atkinson, Joseph Smith, Cornelius B. Atkinson and Jeremiah Smith survivors of James Atkinson sen late deceased as Mortgages all of the County of Monroe and State of Ohio represents that Alexander Ferrell and Rebecca his wife of the County aforesaid (and whom you orators pray may be made parties defendants to this bill) being or pretending to be seized in fee simple of a certain tract of land situate in said county purchased by said Ferril of said James Atkinson sen (now deceased) on Sunfish Creek near Jamestown being the same lot or tract of land on which said Ferrels mill was and is standing being a part of the SouthWest quarter of Section number seven in Township number four of Range number four beginning for the same at a white walnut twelve inches in diameter thence South twenty six degrees East thirteen links thence North forty six degrees East to a sycamore twenty six rods thence North eleven degrees West twenty eight poles and twelve links thence North fifty four and one half degrees east sixteen poles thence North eighty five degrees East twenty two rods to a Lynn?? thence South forty four degrees West twelve rods to a white walnut thence South twenty two degrees West to White walnut nine rods and seventeen links thence South sixteen degrees West to a Buckeye thirteen poles and eleven links thence South two degrees East to a buckeye thirteen rods and twelve links thence South eight degrees West to a stake nine poles thence South eleven degrees South to a ?? twenty seven poles and twenty two links thence South seven degrees East to a white oak twelve rods and nineteen links thence South four degrees

    East to a stake five poles and fifteen links thence North eleven and one half degrees to a Lynn seven poles and twenty links thence to the place of beginning twenty six poles Also beginning at the white walnut station number eight of the above piece running thence South forty eight degrees East thirteen rods to a buckeye then North forty four degrees East twelve and one half rods to a ?? thence North forty six degrees West thirteen poles to a Lynn number seven of the above piece containing thirteen acres and forty seven and three fourths rods note or less. And the said Alexander Ferrel being in wan of five hundred and fifteen dollars he did on the twenty seventh and twenty eight days of September AD 839 apply to the fund commissioners of Monroe County aforesaid to lend him the said sum of five hundred and fifteen dollars to be secured as follows three hundred dollars thereof by your orator Cornelius S. Aktinson and the said James Atkinson sen and two hundred and fifteen dollars thereof by you orator Joseph Smith Cornelius B. Atkinson and Jeremiah Smith by ??? ??? with said Alexander Ferrel and as the ?? Of the said Farrell to the said state of Ohio for the use of the said fund commissioners that the said Ferrell commissioners fund commissioners aid auntie said 20 blank and 20 eight days of September 1839 ?? To the said Alexander Ferrell the said some of $515 at in interest of 7% per annum payable blank annually in advance and blank the said Alexander Ferrell to secure the repayment of the same interest as aforesaid due on the 27th day of September 81,839 obtain your orator Cornelius S Atkinson and the said James Atkinson senior now deceased in his lifetime to blank above with the said Alexander Ferrell and as the securities of the said Alexander Ferrell to the state of Ohio for the use of the said fund commissioners for the sum of $300 and blank part of the said $515 and aid in the 28th day of September 81,829 like your Oradere Joseph Smith Cornelius be Atkinson and Jeremiah Smith to the blank a blank with the said Alexander Farrell and as the securities said I was in the feral through the state of Ohio for the use aforesaid for the sum of $215 residue of the said $515 and your Raiders blank rep presents that he said Ferrell and Rebecca Ferrell his wife in Blaine to second in blank blank and keep playing your Raiders and the said James Atkinson senior from all or any loss have damage trouble like danger or in can the needs and from the payment of any song in blank of money or sums of money either of principal and interest or blank on account or in conveyance of your orators in the said James Ackinson senior so becoming the securities of the said Alexander Ferrell as aforesaid paid on the 28th day of September 18 and 1839 execute and deliver to your Raiders and the said James Ackinson senior mortgage deed of conveyance conveying the above mentioned track of land and premises to your or Raiders and the said James Ackinson senior in fee simple but subject more or less to a condition of a peer and on the payment of the said some of $550 to the fund commission blank aforesaid together with the said interest there on at some per annum payable semi and annually in advanced at the time or times when the said sums composing same full fall do respectively or should fall and be payable so as to the same in??? Pad and keep blank your or Raiders and the said James Atkinson senior from all or any debt here in damages trouble here danger or in convenience and from the payment of any summer sums of money either of principal and interest or ??? on account or in conveyance of your orators and the said James Atkinson senior so becoming the securities of his ??? said Alexander Ferrell as aforesaid and your orators further parent that on the

    Same day two with on the 28th day of September 81, 1839 the said mortgage deed was by the aforesaid Jeremiah Smith one of your orators aforesaid delivered to James Cunningham then recorder of said County for ??? at the recorders office in Woodfield in the said county. And your Orators further represent the said mortgage deed was left and remained in the county and keeping of the recorder from the time of delivery aforesaid until the recorders office aforesaid and the records and papers pertaining to said office was on the first day of January 1840 consumed by fire accidentally since which Time said mortgage deed cannot be found and is something to your orators and you were already is believed that blank was then destroyed by the blank and the fire aforesaid your orators brother represent that neither the said some of $500 or any part thereof nor either the said sum of $300 with said some of $215 part of the said some of $515 nor any part of either of sum parts was paid to the fund commissioners at the time and on this terminus limited in that behalf that the that contrary there of the said elves and Farrell has mended and suffered the sad state of Ohio for the sale of the fund commissioners aforesaid to take a judgment at the test them of the court of common pleas has with in and for the County of Washington and the state aforesaid on the said bond of the hundred and $15 due and a blank some of interest in anthem damages and blank on which judgment and execution was blank out of said court of Washington County directed to the sheriff of Marin County and was put into the of said sheriff which said sheriff blank the said execution of the blank and 10 the Knights of your or Raiders Jeremiah Smith one of the blank aforesaid in said blank blank of $215 whereby the legal a state of said premises because in your own Raiders redeemable Mira sell less in 80 on payment of the principal and interest blank do and to become and they are on and blank to see the same and your readers for the represent that the but since the blank and delivery of said mortgage and for blank Joseph Pollux annual audits Jacob giber Who were partners trading blank the firm of Pollock give her claims to have obtained a judgment against said Alexander ferrell in the Court of Common Pleas Munroe County aforesaid for a large some of money and claimed that the some is A lien on said premises also that John Goshen also that John Goshen William S devotion and Benjamin F fully partners trading under the firm of John Goshen claim to have obtained a judgment for a large sum of money against us at Alexander fairly Court of Common Pleas aforesaid and cleaned the same is lean on said premises also that the following persons claim to have obtained a judgment against the said Alexander ferrell in said court in county of Monroe for large sums of money which they also claim have liens on said tract of land and premises to Whitt William steel and John Gibson partners trading under the firm of steel and Gibson one judgment which was assigned by them to John Gibson senior and buy him signs to William steel John Davenport and James see Miramon partners trading under the firm steel Devonport to and by them assigned to J and G Hopkins the state of Ohio for the use of the fund commissioners Monroe County one judgment all of which said judgment creditors of the said Alexander Ferrell and their assigned to your orators pray may be m??? parties defendants to this piece your orators therefore prayed that the writ of Cepeda against the said some defendants that they may be compelled answer all and singular the matter and things satisfy this bill remains this oriole or readers that are account be taken that since mortgaged premises may be ad and the pharmacist there of applied to the payment of the said some of $515 and the interest and blank blank and accounting interest and blank area respectfully to the payments of said judgment in favor of the state of Ohio for you to be obtained on said bond of $215 in the Court of Common Pleas of Washington County and that after the payment of the said some of $515 together with the interest are blank blank and the blank of the suits that the balance of the proceeds of such they'll be brought into court to be dispensed of among the defendants as this court in equity me blank from deem proper and that your ???

    SUMMARY: Alexander Farell owes money, the Atkinson heirs say that the land the folks are trying to make money on did not belong to Alexander as he didn’t pay for it and the records where such information was kept were burned in a fire on the first of January.
