    The complaint of the plaintiff shows ? the court.
    1st That on the 25th day of February 1877 the plaintiff was married to the defendant at Pensaukee in the County of Oconto State of Wisconsin
    2nd That at the time of said marriage and ever since the plaintiff has been and still is a resident of the County of Oconto State of Wisconsin.
    3rd That at the time of said marriage and ever since the defendant has been and still is an able bodied man, has enjoyed good health and still does, yet he has all of said time refused and neglected to provide for this plaintiff, that said defendant only worked a small part of said time and what wages he earned he spent for cigars. That plaintiff has been compelled to support herself, clothe herself and to do so has worked out for other people nearly all the time since said marriage and still does.
    4th That the plaintiff has always conducted herself towards the defendant as a good and faithful wife should do and has always been

    faithful to the marriage relations existing between herself and the defendant.

    Whereupon the plff demands the judgment of this court that the marriage relations existing between herself and the defendant be dissolved and that both parties be freed there from and such other as further relief as shall be put two equitable with costs

    Pursuant to the order of Refer??? Dated Dec. 15, 1879 on this 18th day of December 1879 personally appeared before me at the City of Oconto in said county the following named persons who by by me duly know usteful as follows:

    My name is Jeremie Scripture: I know plaintiff Ida Phinney. I know defendant Alson Phinney I have known both ever since they were married and before. Plaintiff and defendant were married on or about the 25th of February 1877 in Town of Pensaukee Oconto County State of Wisconsin: They have resided in Oconto County ever since said marriage to my knowledge and they still reside in Oconto County.

    At the time of their said marriage the defendant was a well, able bodied man as far as know he was not sick that I know of but had the appearance of an able bodied man. Ever since his marriage he has enjoyed good health as far as I know. I do not know of his having been sick a single day since his marriage. I have seen him everyday or two or three and he looked well during that time. He did not complain of being sick or act as if he was sick. I know that during and from the time of his marriage he did not provide for wife up to the present time. Deft only worked during that time a small part of the time up to the present time. He spent his wages in whiskey cigars and more whiskey then anything else. My wife has helped clothe her and help out her during that time she has worked some in a shanty and done for me. She still worked for me

    My Name is Ida Phinney and I am the Plaintiff in this suit. I know deft Alsen Phinney. He is my husband. I was married to deft February 25, 1877 at Pesaukee, Oconto Conty Wisconsin. The defendant was an able bodied man when we were married. He has only been ailing a week since our marriage and was not sick then. I resided in Oconto County in Wisconsin when I was married and have resided there ever since. And still reside there. With the exception of defendant ailing a week he has always enjoyed good health since his marriage and been an able bodied man. Except 3 dresses defendant has not bought me any clothes since we were married. My own money and my mother[?] have bought the rest of my clothes. Deft has worked only a small part of the time since my marriage. He spent the wages he earned, most of it for whiskey and tobacco. I have worked out most of the time since I was married for my board and clothes down to the present time and I am still working out. If he had chosen to work he could have earned as good wages as other able bodied men. He could have got work all the time.

    Counselor at hand to whom it was referred by the order of this court to take the testimony of the plaintiffs witnesses do hereby certify that on the 18th day of December 1879 at the City of Oconto in said county of Oconto personally attended before me Jeremie Scripture and Ida Phinney who being each first duly sworn to tell the truth the whole truth and nothing but the truth were severally at ??? by A. Reinhardt Esq. plaintiff attorney and testified as set forth in the foregoing ??? which I then and there reduced to writing and to which the said Jeremie Scripture and the said Ida Phinney each to their own deposition subscribed their names ater the same and hereby we carefully read over to him and her respectively.

    At a special term of this court by on and held at Appleton in Outagamie Court on the 2nd Monday of November 1879 adjourned from this to term to the…?

    This case having come on to be heard upon the complaint of the plaintiff herein the defendant not having appeared hereinwith in person or by attorney, and this case having been referred to R. W. Hubbell Esq. a counsellar of this take the proofs on the part of the plaintiff and expect the same to this court and the same having been reported to this court from which it appears that all the material alligations of the complaint are true and that the defendant “has been and is” guilty of neglecting to provide for the plaintiff although being of sufficient ability so to do.

    Now on motion of A. Reinhart attorney for the plaintiff “adjudged” that the bonds of matrimony between the plaintiff Ida Phinney and Alson Phinney be and the same are hereby dissolved and the said parties are and each of them is freed from the obligations thereof.

    And it is further adjudged that the plaintiff recover of the defendant her costs and disbursements herein amounting to $45 76/100
