The regiment comprised a part of the 1st brigade, 1st cavalry division, Military Division of the Gulf and had its headquarters at San Antonio until February 15, 1866, when it was dismounted and mustered out of service. -------------------------- Charge and specifications against Private Abram Rosa Co “L”, 3d Regiment Michigan Vol Cavalry. Charge - Conduct prejudicial to good order and Military discipline. Specification 1st, In this that he the said Private Abram Rosa, Co “L”, 3d Regiment Michigan Vol Cavalry did use insulting and threatening language towards his Superior Officer, Major Thomas B. Weir, 3d Regiment Michigan Vol Cavalry, in substance as follows, “No God damned Officer shall abuse that man, “Look here,” God damn you, you have churned that man enough, “ I’ll show you, by God. This near Eagle Pass Texas in or about the 7th day of September 1865. Specification 2d, In this that he the said private Abram Rosa, Co “L”, 3d Regiment Michigan Vol Cavalry did take off his coat and shake his fists in a threatening manner towards his Superior Officer, Major Thomas B. Weir*, 3d Regiment Michigan Cavalry and at the same time did make use of insulting and threatening language. This near Eagle Pass Texas in or about the 7th day of September 1865. *Major Weir - commanded Company D of the 7th Cavalry under Custer, joining him in the attack on a large Native American encampment on the Little Bighorn River in Montana on June 25, 1876. Weir disobeyed orders to remain on what is now Reno Hill, and instead, moved north to attempt to support Custer, who had led a detachment to attack the encampment from that direction. The effort was too late. He died in 1876 having drank himself to death. It is believed over the loss of Custer, whom he revered. I can’t believe that Abram would have shown any sadness at his passing. It is interesting that Weir allows Abram to be sent to hard labor in a horrible prison for three months, when he was only trying to protect a fellow soldier from over-enthusiastic punishment. Yet he disobeys orders to protect Custer from a disastrous attack, fails, and wasn’t punished by his superior officers. But justice comes in many forms. --------------------------- Head Quarters Cavalry Forces Military Division of the Gulf San Antonio, Texas, November 5th 1865. General Orders I. Before a General Court Martial which convened at this place pursuant to S. O. No. 17, Extract 2, dated San Antonio Texas, Octo. 19th, 1865, from the Head Quarters Cavalry Forces, Military Division of the Gulf, and of which Major T. D. Vredenburg, 10th Illinois Cav., is president, was arraigned and tried: 17th Private Abram Rosa, Co. “L”, 3rd Michigan Cavalry. Charge: Conduct prejudicial to good order and Military discipline. Finding: Guilty Sentence: To be confined at hard labor for three months, at such place as the commanding General may direct, with loss of all pay and allowances for the same time. II. The proceedings, findings and sentence in the case of: Private abram Rosa, Co. “L, 3rd Mich. Cav., are approved. The Dry Tortugas is hereby, designated a the place of confinement. The Regimental Commanders will cause stoppages to be made. VIII. The above named prisoners, ordered to be confined at the Dry Tortugas, will be sent under guard with a copy of this General Order, and descriptive lists, to the Provost-Marshall-General, Mil. Div. of the Gulf. The commanding General 1st Cav. Division is charged with the execution of the same. According to his military papers Abram was absent in military confinement as San Antonio, Texas from September at time of incident to November at time of sentencing, at which time he was sent to Dry Tortugas, Florida, Fort Jefferson for 3 months hard labor, sentenced November 15. Mustered out in Texas Rolls February 12, 1886(this date is erroneous, because he had no papers when he was returned at end of prison term and was sent to Detroit), then Detroit, Michigan April 26, 1866(this date is probably the correct one). Released from prison February 22, 1866. Came to Berrien county in 1852 with his brother Joseph and worked as a lumberman and farm laborer. Abram wrote that he couldn’t afford a doctor and was using home remedies. Harriet (Hata) Emerson is stated as his second wife he had two sons with her; John and Alby. He says that his first wife Janett Smith left him during the Civil War and moved to Oconto, Wisconsin and she died there. This means that she died between 1870 and 1898[we know she was dead by 1877 because of daughters land deed in Michigan selling their inherited property to their mother’s brother]. So her death date of 1876 from Irv could be correct. We still don’t know if they were divorced, separated or annulled. Peter Clapsaddle is a witness to a document signing as is Alby Emerson Depositions from: Alex Finch, Abner Branard, Joseph Harris, William Ferguson, Solon Cutter, James Nelson, Perry Roome, George McCormick, Theophulus Hardenbrook, Henry Hermistan, Thomas Botham I remember seeing a SMITH name witnessing some documents signature, but I can’t find it now. An interesting bit of reading from the examiner doing the analysis, “P.S. It may be proper to state that claimants brother and sister both have very pale weak looking eyes. Their eyes remind me of the eyes of a dead fish. and claimants brother Abram now has cataract of one eye that first appeared about five years ago. The Rosa family were very ordinary people and had no social standing what ever before the war. Formerly Abram was regarded as no better than the rest of the family. but of late years he has had a good reputation.” [3, 4, 5] | |
